My case is like this, my original labor application was filed in Dec '04 under EB3 and it has been approved in Feb '07. Is it possible for me to file i140 in EB2. My paralegal says you can but just wanted to gather more information.

Every Tuesday, USCIS releases its data on the pace of usage of H-1B numbers. I'm monitoring that usage and projecting the end date for H-1B numbers. It's not complicated science, but I'm basically using a rolling average of the prior four weeks of H-1B usage to minimize the anomolies of one particular week and then assuming that usage over the prior month will continue at roughly the same pace. If usage picks up, the exhaustion date will be revised to be sooner and vice versa if usage declines. We actually saw a decline from prior weeks with 800 H-1B applications...

In addition to contacting the law makers, we should be contacting the media to highlight our plight. I just read on IP that the media is unaware of the BEC mess (http://www.immigrationportal.com/showpost.php?p=1406956&postcount=3019) and would be interested in taking it up. We have just received another H-1 approval for an end-client placement. There were two intervening vendors and the end-client declined to provide a letter stating that there is no requirement in law for them to provide any such letter. We had to get together convincing secondary evidence. I was highly doubtful we will get the approval, but we did. So, despite the January 8 memo from USCIS, there is life yet for consulting industry.

You should be able to contiue your GC without interruption even if you did not work for the sponsoring employer. but just make sure you are employed with the sponsoring employer before filing for I-485.
You may need a new H1 to go back to the previous employer. But GC should not be affected.

There is no such thing as AP Renewal, it is always a fresh application. That is the reason application does not mention anything about renewal.

I used Ap in 2007 and than I filed H-1B extension 6 month prior to my H-1B expiring in sept 2008. which was approved with the sameI-94 as on parolee status.
I want to use AP again, is there any problem.

I think many of us would be in this situation. I am using my EAD for work and last year used AP to enter US. Parole Officer Stamped one year of validity date on my I-94 that is paroled until March 2009. Now I have new EAD which is valid for two years 2010 and New AP Dec' 2009 for one year of travel. My understanding was your date on I-94 indicates your legal status. So what would happen to my status once i stay after March 2009? I am planning to travel to India in June 2009.

I am in my 8th year H1-B( came in 1999 first to USA) extension based on pending I-140 & I-485 , I have my 2nd EAD in So now my question is
Is it safe for me to switch to EAD or keep extending my H1-B till I have my I-140 and 485 is approved? My I-140 has been pending for the last 2 yrs because of the FBI security checks etc. Since my H1-B extension beyond 6 yrs is based on pending I-140 and I-485 does it really make sense to keep extending it since I have to pay from my end my employer doesnt pay for it or is it better to be on EAD?
